Whimsy Socials - Terms and Conditions

Welcome to Whimsy Socials! By purchasing a ticket, registering for an event, or attending any gathering hosted by Whimsy Socials, you (the "Attendee") agree to the following Terms and Conditions. Please read them carefully.
 

1. Ticket Sales and Refund Policy
 

1.1 Non-Refundable Tickets: All ticket sales are final. We do not offer refunds, partial refunds, or credits for no-shows, late arrivals, or cancellations made by the Attendee. 

1.2 Ticket Transfers: If you are unable to attend, you may transfer your ticket to another person. Please notify us at Contact@WhimsySocials.com at least 24 hours before the event to update the guest list. 

1.3 Event Cancellations: In the rare event that Whimsy Socials must cancel an event (e.g., due to severe weather or venue emergencies), attendees will be offered a choice between a full refund or a credit for a future event.
 

2. Child Safety and Supervision
 

Whimsy Socials is proud to be an inclusive space for all ages, including children and expecting parents. However, the safety of minors is the sole responsibility of their accompanying adults. 

2.1 Active Supervision Required: All children under the age of 18  must be accompanied and actively supervised by a parent or legal guardian at all times.

 2.2 Hazard Warning (Small Parts): Please be mindful that some of our events may feature arts, crafts, games, or activities that utilize small parts, beads, or other materials. These items may present a choking hazard for infants and young children. Parents and guardians are strictly responsible for monitoring their children to prevent the ingestion or misuse of any event materials. 

2.3 Liability for Minors: Whimsy Socials, its founder, staff, and venue partners assume no responsibility or liability for the safety, supervision, or injury of children attending the event.
 

3. Media and Photography Release
 

3.1 Consent to be Photographed/Recorded: We love capturing the joy of our community! By attending a Whimsy Socials event, you consent to being photographed, filmed, and/or recorded. 

3.2 Use of Media: You grant Whimsy Socials the irrevocable right and permission to use, publish, reproduce, and distribute any photographs, video, or audio taken of you (adult) during the event. This media may be used for marketing, advertising, social media, website content, and any other promotional purposes without compensation to you. 

3.3 Opting Out: If you  prefer not to be photographed, please inform a Whimsy Socials team member immediately upon arrival at the event, and we will do our absolute best to accommodate your request and keep you out of promotional shots.
 

4. Code of Conduct and Inclusivity
 

4.1 Safe Space Policy: Whimsy Socials is a fully inclusive environment for LGBTQIA+ individuals, neurodivergent people, people with disabilities, elders, children, and people of all backgrounds. Hate speech, discrimination, harassment, or disruptive behavior of any kind will not be tolerated. 

4.2 Right to Refuse Entry: We reserve the right to refuse entry or remove any Attendee from an event without a refund if their behavior violates our safe space policy, endangers others, or disrupts the flow of the event.
 

5. Assumption of Risk and Liability Waiver
 

5.1 Assumption of Risk: By attending a Whimsy Socials event, you acknowledge that participation in social events involves inherent risks, including but not limited to, property damage, illness, or personal injury. You voluntarily assume all risks associated with your attendance. 

5.2 Release of Liability: To the maximum extent permitted by law, you agree to release, waive, and hold harmless Whimsy Socials, its founder (Nia Carson), employees, volunteers, independent contractors, and venue partners from any and all claims, liabilities, damages, costs, and expenses arising out of or related to your participation in the event. 

5.3 Personal Belongings: Whimsy Socials is not responsible for any lost, stolen, or damaged personal property brought to the event.
 

6. Health and Safety
 

6.1 Wellness: If you are feeling unwell, experiencing symptoms of a contagious illness, or have recently been exposed to a communicable disease, we ask that you stay home to protect our community. 

6.2 Venue Rules: Attendees must comply with all posted rules and safety guidelines established by the specific venue hosting the Whimsy Socials event.
 

7. Governing Law
 

These Terms and Conditions shall be governed by and construed in accordance with the laws of the District of Columbia (Washington, D.C.), without regard to its conflict of law principles.
